§ 100.102 Cost of special elections and special primary elections to be incurred by the state.

Overview of Statute

This statute governs the expenses incurred during special elections and special primary elections. It states that each county’s expenses are to be reimbursed by the state, and that reimbursement is based on actual expenses filed by the supervisor of elections. The Department of State verifies the expenses and authorizes reimbursement by county.

Statute

Whenever any special election or special primary election is held as required in s. 100.101, each county incurring expenses resulting from such special election or special primary election shall be reimbursed by the state. Reimbursement shall be based upon actual expenses as filed by the supervisor of elections with the county governing body. The Department of State shall verify the expenses of each special election and each special primary election and authorize payment for reimbursement to each county affected.

Definition [Governing Body]

As used in ss. 101.292-101.295, “governing body” means the board of county commissioners of a county or any other governing body empowered by general or special act or local ordinance to purchase or sell voting equipment. Fla. Stat. § 101.292(1).

An election held preceding the general election for the purpose of nominating a party nominee to be voted for in the general election to fill a national, state, county, or district office. Fla. Stat. § 97.021(29).
